PSP Franchising, LLC v. SureFed Plus, LC, et al., No. SA-25-CV-00544-XR

Pet Supplies Plus franchisor PSP Franchising, LLC sought emergency injunctive relief against former franchisee SureFed Plus, LC after the franchisee declined to renew its San Antonio franchise agreement and continued operating a competing pet supply store at the same location. PSP moved to enforce the franchise agreement's post-termination non-compete and shut the business down. Luther Lanard, led by attorney Elena Sandell, prevailed on the motion. While the court found PSP likely to succeed on its breach-of-contract claim, it declined to enjoin the competing operation — holding that PSP failed to demonstrate the imminent, irreparable harm required for preliminary injunctive relief. The court found PSP's evidence of goodwill damage, confidential information misuse, and lost refranchising opportunity insufficient or too speculative, with most alleged harm compensable through damages. On trademarks, the court entered a limited injunction barring use of PSP's marks and customer lists — relief the client was already in compliance with having de-identified. The balance of hardships weighed in our client's favor, and the business remained open.

Fetch! Pet Care Inc., v. Atomic Pawz Inc. et al, U.S. Dist. Court, E.D. Mich. Case No. 2:25-cv-11568

Fetch! PetCare terminated 36 of its franchises. The franchisees deidentified and continued to operate independently after termination. Fetch! then filed a motion seeking to enjoin trademark infringement and enforce the franchise agreements' non-compete provisions. Luther Lanard, led by attorney Bryan Dillon, represented all 36 locations and prevailed on the motion, successfully blocking Fetch!'s attempt to shut down the former franchises. The Defendants stipulated to an injunction regarding the trademarks, since they had no desire to use the marks and instead had deidentified using new names. Following a two day evidentiary hearing, the court declined to enforce the non-compete provision finding that the 4 prongs of the test for injunctive relief weighed in favor of Defendants and against granting Fetch! injunctive relief.

Luther Lanard, led by attorney Daniel Ngai, represented a franchisee quick-service poke bowl restaurant who was sued in federal court (Central District of CA) by its franchisor for a list of allegations including breach of contract, fraud, tortious interference, trade secret misappropriation, and conversion. The Court granted summary judgment in our clients' favor, thereby disposing of the franchisor's entire complaint.
